OCR: How harassment of Students in Education Programs May Constitute Discrimination Under Civil Rights Laws

The session will be presented by OCR Attorney Michael Pillera. The technical assistance presentation will provide an overview of OCR and the statutes within OCR’s enforcement. The presentation will provide an overview of prohibitions of discrimination within Federal civil rights laws, focusing on disability-based harassment pursuant to Section 504 of the Rehabilitation Act of 1973 (Section 504) and Title II of the Americans with Disabilities Act of 1990 (Title II), and provide some general information regarding harassment on the bases of race, color, national origin, and sex pursuant to Title VI of the Civil Rights Act of 1964, and Title IX of the Education Amendments of 1972. The presentation will also provide some brief information in regards to the provision of a free appropriate public education (FAPE), pursuant to Section 504 and Title II, and will provide time for questions from participants.
