Testing, Classification, and Placement of Students With Disabilities Into A Bilingual/ESL Program

Texas Administrative Code (TAC) §89.1225(f) requires districts to use specific criteria for entry into a Bilingual/ESL program. For students with disabilities who also qualify as ELLs, the decision for entry into a Bilingual or ESL program shall be determined by the ARD committee in conjunction with the LPAC (TAC §89.1225 (f)(4). Participants will obtain recommendations for and address potential problems affecting Bilingual/ESL placement decisions for students with disabilities who also qualify as ELLs [TAC §89.1225 (f)(4) and §89.1230 (a)(b)].

Participants will become aware of TAC §89.1225(f)(4) which allows districts to determine an appropriate assessment instrument and designated level of performance for indicating limited English proficiency for students whom state approved tests would be inappropriate as part of the IEP.

Targeted for Campus ARD and LPAC key members involved in the process of exiting students with special needs from a Bilingual/ESL program. Additional audience may include administrators of Special Education and Bilingual Education Programs.
